Terms of Service

Draft. These terms describe how we actually operate, but they have not yet been reviewed by a lawyer. If anything here matters to your decision, ask us and we will put it in writing.

These terms cover the website service Virgil Finch provides to your funeral home. Virgil Finch is a sole proprietorship operating in Pennsylvania, run by one person; where these terms say "we", that is the business you are contracting with, and the proprietor's full legal name appears on every invoice and is yours on request. Plain language on purpose: you should be able to read this once and know what you are agreeing to.

What we provide

We design, build, host and maintain a website for your funeral home. That includes the pages, the obituary system, the enquiry forms, hosting, an SSL certificate, and ongoing changes you ask us for. Your site is served from a subdomain we provide, or from your own domain if you have one.

What it costs

$297 per month. No setup fee and no build fee.
Sales tax is added where your state charges it on services of this kind. It is calculated at checkout, shown before you pay, and itemised on every receipt. Some states add nothing.
Billed monthly in advance. The first charge is taken when you approve the site.
Prices may change with 30 days' written notice. Any change applies from your next billing date, never retroactively.

Cancelling

Month to month. Cancel any time by telling us — no notice period, no cancellation fee, no minimum term. Your site stays up until the end of the period you have paid for. We do not issue partial refunds for a month already begun.

Your content, and who owns what

Everything you give us — your text, photographs, obituaries, price lists, your name and marks — remains yours. We use it only to run your site.
The underlying platform, templates and code remain ours.
On cancellation you may ask for an export of your content, including your obituaries, and we will provide it in a readable format.
You confirm you have the right to use what you give us, including photographs of staff and any material provided by families.

Obituaries and families' information

Obituaries you publish are visible to the public, which is their purpose. You are responsible for having the family's permission before publishing a notice, a photograph, or service times. If a family asks for a notice to be amended or removed, tell us and we will act on it promptly.

What we do not do

We do not guarantee any particular number of enquiries, search ranking, or volume of business. Anyone who does is guessing.
We aim for continuous availability but do not guarantee uninterrupted service. Hosting, domains and email depend on third parties.
We do not provide legal, regulatory or pricing advice. Complying with the FTC Funeral Rule and your state licensing requirements remains yours.

Liability

Our total liability in any twelve-month period is limited to the fees you paid us in that period. We are not liable for indirect or consequential loss, including lost business. Nothing here limits liability that cannot lawfully be limited.

Suspension

If payment fails we will contact you. If it remains unpaid we may suspend the site, which replaces it with a holding page. Nothing is deleted on suspension. Settle the balance and the site returns exactly as it was.

Changes to these terms

If we change them materially we will tell you by email at least 30 days beforehand. Continuing to use the service after that means you accept the change.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, and any dispute will be brought in the courts of that state.

This covers two different groups of people, and it matters which one you are: funeral homes who contact us about the service, and families who use a funeral home's website that we host.

If you enquired with us

What we collect

What you type into the enquiry form: your business, your town, and anything else you tell us.
Your name, telephone number and email address, if you give them.
Which of our sites the enquiry came from.

Why

To reply to you, build the mockup you asked for, and keep a record of the conversation. We do not sell it, rent it, or share it with anyone for their own marketing.

How long

Until you ask us to delete it, or until it is clearly no longer relevant. Ask and we will remove it.

If you are a family using a funeral home's website

We host the site on the funeral home's behalf. The funeral home decides what is on it and what happens to what you send. We process it for them, and only to deliver it to them.

Anything you put in a contact form — your name, telephone number, email address and message — is passed to the funeral home and stored so they can see it.
If you subscribe to obituary notifications, we store your email address and send you a confirmation link. Subscribing requires you to confirm. You can unsubscribe from any notification with one click.
Obituaries themselves are published by the funeral home. If you want a notice about your relative amended or removed, contact the funeral home directly, or us, and we will act on it.

What we do not do

We do not sell personal information to anyone, ever.
We do not run advertising trackers, third-party advertising pixels, or cross-site profiling on the sites we build.

Who else touches your data

Only the suppliers needed to run the service: our hosting provider, our database provider, and the services that send email and text messages on a funeral home's behalf. They act on our instructions and cannot use your information for their own purposes.

Your rights

You can ask us what we hold about you, ask for it to be corrected, or ask for it to be deleted. Write to us and we will respond. If you are in a jurisdiction with additional rights — California, the EU, the UK — those rights apply and we will honour them.
